Appeal Watch: Green Belt Housing Appeal Allowed inBenfleet, Essex
Outline planning permission has today been granted by the Planning Inspectorate for up to 47 dwellings, 50% of which would be affordable following the conclusion of a lengthy planning application determination process and subsequent appeal.
Considering the appeal under the written representations procedure, Inspector C Carpenter BA MA MRTPI concluded that the site made only a weak contribution to purposes (a) and (b) and no contribution to purpose (d) of the Green Belt. It was moreover considered that the proposed development would not fundamentally undermine the purposes (taken together) of the remaining Green Belt across the area of the plan, would meet an identified need for housing, would be in a sustainable location, and would moreover meet the ‘golden rules’ requirements. Accordingly, the Inspector agreed with our case that the proposed development of the site would not be inappropriate development in the Green Belt. The Inspector moreover agreed with the case put forward on behalf of the appellant that potential impacts on protected European Sites could be suitably mitigated through financial contributions.
